Terms and Conditions

Here we set out the basis on which SkyFocusUK provides its drone photography and video services. They are designed to give clients clear information about bookings, responsibilities, payments, cancellations, flight operations and the use of imagery.

1. About These Terms

These Terms and Conditions apply to drone imagery services supplied by SkyFocusUK (“we”, “us” or “our”).

By accepting a quotation, making a booking or instructing us to begin work, the customer (“you” or “your”) agrees to these Terms.

2. Services

We provide aerial photography, aerial video and visual property imagery using remotely piloted aircraft.

The exact services, location, deliverables, price and any agreed timescale will be set out in the quotation or booking confirmation.

3. Visual Imagery Only

Unless expressly agreed otherwise in writing, our service provides visual imagery only.

It is not a structural survey, building survey, engineering report, roofing assessment, electrical inspection, insurance assessment or professional diagnosis.

Any decisions based on the imagery should be made with advice from an appropriately qualified professional.

4. Quotations and Acceptance

Quotations are valid for [30] days unless stated otherwise. A contract is formed when you accept our quotation in writing, pay any required deposit or instruct us to proceed. Changes to the agreed scope may result in additional charges.

5. Customer Authority and Permissions

You confirm that you are authorised to request the service at the stated property or location.

You are responsible for obtaining permission from the property owner, occupier, site manager or other relevant person where required.

You must tell us about any access restrictions, known hazards or sensitive areas before the visit.

6. Site Access and Safety

You must provide safe and reasonable access to the agreed operating area.

The remote pilot has final authority over whether a flight can be conducted safely and lawfully.

We may refuse, suspend or stop work where conditions, people, animals, vehicles, structures or other hazards create an unacceptable risk.

7. Weather, Airspace and Flight Restrictions

All flights are subject to suitable weather, visibility, airspace restrictions, local conditions, regulatory requirements and safe take-off and landing arrangements.

We may postpone, relocate, modify or cancel a flight where it cannot be completed safely or lawfully.

A postponement caused by these factors will not normally be treated as a cancellation by us.

8. Appointments and Delays

Any stated date or time is an estimate unless expressly confirmed as fixed.

We will take reasonable steps to attend as agreed, but we are not liable for delay caused by weather, airspace restrictions, equipment safety concerns, access problems, emergencies or events outside our reasonable control.

9. Prices and Payment

Prices/Fees will be shown in the quotation.

Upon agreement, full payment will be made to secure and book the required service.

Deliverables may be withheld until cleared payment is received.

10. Customer Cancellation

Cancellations must be made in writing.

A 10% cancellation fee will be applied for reasonable costs already incurred, including travel, permissions, specialist planning or third-party charges, and the remaining amount will be refunded.

11. Cancellation or Postponement by SkyFocusUK

Where we cannot complete the work for safety, legal, weather or operational reasons, we will normally offer a new date.

Where we permanently cancel the service and no work has been supplied, any payment for the uncompleted service will be refunded.

This does not affect charges for work already completed or costs already properly incurred.

12. Delivery of Images and Video

Deliverables will be supplied in the format and resolution stated in the quotation.

Estimated delivery times begin after the flight or after receipt of all necessary customer instructions, whichever is later.

Raw, unedited or original files are not included unless specifically agreed.

13. Revisions

The quotation will state whether editing or revisions are included.

Requests outside the agreed scope, including additional editing, alternative formats, replacement music, extended storage or re-delivery, may be charged separately.

14. Copyright and Customer Licence

Unless agreed otherwise in writing, copyright in all photographs, video and other creative material remains with SkyFocusUK.

Once full payment has been received, you are granted a non-exclusive licence to use the agreed deliverables for the purposes stated in the quotation. You may not sell, sublicense, materially alter or provide the material to third parties for unrelated commercial use without our written permission.

15. Portfolio and Promotional Use

We may use selected images or video in our portfolio, website, social media and promotional material unless you ask us in writing not to do so before the flight.

We will take reasonable care not to publish confidential or sensitive information.

16. Privacy and Incidental Capture

Drone imagery may incidentally include neighbouring land, vehicles or individuals.

We will operate with reasonable regard for privacy and applicable data-protection law.

You must use the supplied material lawfully and must not use it to harass, monitor or intrude upon another person’s privacy.

17. Storage and File Retention

We will retain completed files for approximately 12 months (1 year), but permanent storage is not guaranteed.

You are responsible for downloading and securely backing up delivered files.

Retrieval or re-delivery after the stated retention period may not be possible or may incur a charge.

18. Liability

Nothing in these Terms excludes liability that cannot legally be excluded.

Subject to that restriction, our liability arising from the service will be limited to the amount paid for the relevant booking.

We are not liable for indirect loss, loss of profit, loss of opportunity, decisions made from visual imagery, pre-existing property defects or matters outside the visible areas captured.

19. Insurance and Regulatory Compliance

We will operate in accordance with applicable UK aviation rules and maintain insurance appropriate to the service where required.

Evidence of insurance may be provided on request.

20. Complaints

Please raise any concerns as soon as possible using the contact button below.

Complaints about delivered files should be made within 7 days of delivery, with sufficient details for us to investigate.

Where required and reasonable, we will carry out another visit and retake images and video at no additional cost.

21. Events Outside Our Control

We are not responsible for failure or delay caused by events beyond our reasonable control.

These include severe weather, temporary flight restrictions, emergency-service activity, regulatory action, power failure, equipment safety issues, illness, transport disruption or site-access problems.

22. Changes to these Terms

We may update these Terms from time to time.

The version that applies to a booking will normally be the version provided or published when the booking was accepted.

23. Governing Law

These Terms are governed by the law of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory consumer rights that apply.

24. Contact Details

SkyFocusUK operates as an online, remote-based business.

By avoiding the substantial overheads associated with maintaining offices and other commercial premises, we are able to keep our operating costs under control.

These savings allow us to offer professional drone imagery services at competitive rates, without compromising on the quality of the service or the imagery we provide.
